Introduction
A witness statement should ‘tell the story’ in chronological order, it is the ‘shop window’ of the investigation and must include all the facts.
This course covers the relevant legal principles and provides practical advice for taking witness statements.
What the Course covers
By the end of the learning you will be able to:
- State the different types of witness
- Describe the role of the witness
- Distinguish between recognition and identification
- State what evidence is required from a witness to enhance their investigation
- Understand the importance of R v Turnbull
- Professionally handle a reluctant or hostile witness
- Explain the procedure for dealing with intimidated witnesses
- Determine when to provide the witness with a copy of their statement
- Explain the legal position on competence, compellability and availability for cross examination
- Identify when a victim personal statement should be taken
- Explain the support provided by the witness care unit
- Know when to obtain a rebuttal statement
- Explain the importance of the PEACE model and the Principles of Investigative Interviewing when dealing with witnesses
- Identify the most appropriate question types and when to use them
- Understand what constitutes active listening and why this is crucial in any interview
- Demonstrate the accurate recording of statements to the standards required by the courts.
- Take witness statements over the telephone.
- Demonstrate the principles of the Cognitive Interview technique.
- Demonstrate through role play their ability to interview a witness and draft a statement
Who should attend?
The course is relevant for all counter fraud staff who gather evidence and want to understand how to effectively interview potential witnesses and draft a statement to the required standards.
How will you be taught?
The Course is delivered over one day via the Zoom platform. We use a range of different methodologies to cater for all students learning.
Assessment and Accreditation Criteria
Students have the opportunity to assess their learning through small group exercises. Upon completion of the course, students will receive certification.
