Introduction
For far too long there have been cases where the statutory duties of disclosure under the Criminal Procedure and Investigations Act 1996 (and subsequent amendments), Attorney Generals Guidelines 2024 and at Common Law have not been adhered to.
The Horizon scandal being one of them. On this course you will learn how to get it right!
What the Course covers
By the end of the learning you will be able to:
- State the general rules of disclosure under Common Law
- List material that should be disclosed as part of the Initial Details of the Prosecution Case (IDPC)
- Explain why the CPI Act was introduced
- State your role in the disclosure process
- Understand the roles and responsibilities of those involved in disclosure
- State the commitments listed in the National Disclosure Improvement Plan by the National Police Chiefs Council 2018
- Apply the four Rs of record, retain, review and reveal
- Apply the relevance test
- Explain the importance of following all reasonable lines of enquiry
- State the importance of fully describing material
- Define sensitive material
- Redact and or copy material that contains sensitive or confidential information
- Apply the necessity test
- Identify material that meets the test for disclosure
- Disclose to the defence at the request of the prosecutor
- Recognise when a Public Interest Immunity (PII) application may be needed
- Explain the importance of maintaining a continuing duty to review disclosure
- State what the defence should include on a defence statement
- Take action on receipt of a defence statement
- Understand how requests for further disclosure are managed
- State the procedures for dealing with sensitive material schedules
- Apply the Attorney Generals Guidelines of 2024
- Recognise material that has a disclosure presumption
- Apply the Attorney Generals Guidelines on block listing
- Recognize the importance of early defence engagement
- Handle CHIS (covert human intelligence source) material
- Deal with surveillance authorizations
- Apply best practice when handling digital material
- Explain disclosure obligations when an expert witness is used
- Disclose material held by third parties
- Explain how material gathered during financial investigations should be treated
- Recognise when Investigation and Disclosure Management Documents need to be completed
- Demonstrate the disclosure officer’s role by completing schedules and reports using a case study
Who should attend?
Considering what is required for full disclosure impacts on the very beginning of an investigation therefore this course is relevant for all counter fraud staff wishing to enhance their understanding of the CPIA to ‘get it right’ and the ramifications of ‘getting it wrong’!

The Course is delivered over one day via the Zoom platform. We use a range of different methodologies to cater for all students learning.
Assessment and Accreditation Criteria
Students have the opportunity to assess their learning through small group exercises. Upon completion of the course, students will receive certification.
